ENTRY TIMELINE All entries must be received by August 18, 2007 to be eligible for the drawing.
TO ENTER BY INTERNET: You may enter via the Internet by visiting http://usadiving.newtier.com/ All on-line entries must be received during the published period of this promotion. Only one internet entry per person per e-mail address per month will be accepted.
WINNER SELECTION: The Winner will be notified by e-mail within three (3) days after the drawing, provided that the Winner is available at the e-mail address supplied by the Winner on the entry form. Drawing will be conducted by New Tier Inc. The drawing is final and binding. Odds of winning depend on the number of eligible entries received. Prize is guaranteed to be awarded. Winner will be notified by mail, telephone and/or e-mail, and may be required to execute and return an Eligibility Affidavit/Release of Liability/Publicity Release and completed IRS W-9 form within 14 days of issuance of notification or an alternate will be selected in a subsequent random drawing. Prize won by a minor will be awarded in the name of his or her parent or legal guardian. If travel is involved with any prizes, the winner's travel companions are also required to execute and return a Liability Release within this same time deadline. Winning named parent or legal guardian will be required to execute required documents on behalf of a travel companion that is their minor child or ward. A minor will not be allowed to participate in any portion of a travel prize without being accompanied by their winning parent or legal guardian. Any prize notification or prize returned to the Sponsor or their fulfillment company as undeliverable for any reason will be awarded to an alternate. No substitution by the winner for their prize shall be allowed. If necessary due to unavailability, a prize of equal or greater value will be substituted at the sole discretion of the Sponsor. Prize is not transferable or redeemable for cash. All Federal, state, local or other tax liabilities are the sole responsibility of the winner. Acceptance of the prize constitutes permission (except where prohibited by law) to use the winner's and winner's travel companions' names, likenesses and statements for publicity purposes without additional compensation or limitation.
ELIGIBILITY: GIVEAWAY OPEN TO INDIVIDUAL LEGAL RESIDENTS OF THE FIFTY, CONTIGUOUS STATES, AT TIME OF ENTRY. Online entrants must participate by way of an Internet Service Provider or other method of Internet access and have a personal e-mail address. Employees (and their families and members of the same household) of New Tier Inc. and its respective affiliates, subsidiaries, advertising and promotional agencies are not eligible. All federal, state and local laws and regulations apply. Void outside the United States of America and where prohibited and restricted by law. Individuals not residents of the United States are not eligible.
PARTICIPATION/ACCEPTANCE OF RULES: By participating, entrants agree to the official rules, accept decisions of New Tier Inc., and warrant that they are eligible to participate in the giveaway. Entrants agree to allow New Tier Inc. to periodically send notification of special offers and promotions via email. If you do not wish to continue receiving e-mails, you may opt-out at any time by following the instructions included in the e-mail.
LIABILITY: If, for any reason, the giveaway is not capable of running as planned, including infection by a computer virus, bugs, tampering, unauthorized, intervention, fraud, technical failures, or any other causes beyond the control of New Tier Inc. which corrupt or affect the administration, security fairness, integrity, or proper conduct of this giveaway. New Tier Inc. management reserves the right at its sole discretion to cancel, terminate, modify or suspend the giveaway. All federal, state and local taxes associated with the acceptance of the prize are solely the responsibility of the winner. No cash redemption, substitution or transfer of prizes allowed. By participating in the giveaway, each participant agrees to release and hold New Tier Inc. and its employees, officers, directors, shareholders, agents, representatives, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the giveaway or resulting from acceptance, possession, or use of any prize.
GENERAL: Entrants agree that New Tier Inc. and their respective employees, officers, directors, shareholders, parent companies, affiliates, subsidiaries, agencies and any other companies participating in the design, administration or fulfillment of this promotion (Collectively Releases), shall not be liable for injuries, damages, expenses or costs or losses of any kind resulting from participation in this promotion or acceptance of or use or misuse of the prize or parts thereof.
Sponsors reserve the right to terminate on-line entry if technical difficulties compromise the integrity or ability to continue on-line entry. If on-line entry is terminated, notification will be sent to individual by e-mail. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. All correctly completed entries received on-line as of termination date received through the entire promotion, will be included in the random drawing. Where a dispute arises about who submitted an on-line entry, the entry will be deemed submitted by the holder of the e-mail account. Entrants agree to allow sponsors to periodically send notification of special offers and promotions via email. PRIVACY POLICY Effective Date: Sept. 1, 2005 Your privacy is important to us. New Tier Communications respects and protects the privacy of our customers. We carefully ensure the confidentiality of each customer's account information. We recognize that, as the provider of online services, we must also ensure the privacy of each customer's personal information. Collection of Personal Information New Tier Communications and their partners collect personal information in a number of circumstances. For example, when you visit a New Tier Communications hosted website, we may collect personal information from you such as name, home address, e-mail address, age, favorite sports team, purchase history, subscription history, phone number used to call customer service and credit card information for purposes such as events and contests, pay per view, monthly and annual subscriptions; registrations for newsletters, video highlights and video offerings, chat room and bulletin board; shopping in the shopping area; and participation in other promotions and interactive online activities. We may collect personal information with your consent or as required or permitted by law. We may receive and store certain types of information whenever you visit the Site. Chat Rooms, Forums, and Message Boards The Site may make chat rooms, forums and message boards available to its users. You are not required to provide any personal information when using these areas but you may choose to do so. If you post personal information online, it will be publicly available and you may receive unsolicited messages from other parties. New Tier Communications cannot ensure the security of any information you choose to make public in a chat room, forum, or message board. We cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information in these areas. Links to Other Websites You should be aware that when you are on the Site you could be directed to other sites beyond our control. For example, if you "click" on a banner advertisement, the "click" may take you off the Site onto a different Web site. This includes links from advertisers, sponsors and partners that may use the Site's logo as part of a co-branding agreement. These other Web sites may send their own cookies to you, independently collect data or solicit personal information and may or may not have their own published privacy policies. If you visit a Website that is linked to our Site, you should consult that site's privacy policy before providing any personal information. This policy applies only to this Site.
Security This Site incorporates reasonable safeguards to protect the security, integrity, completeness, accuracy and privacy of the personal information that we may collect and we have put into place reasonable precautions to protect such information from loss, misuse and alteration. Your personally identifiable information is transferred to our computers utilizing encryption software. Only those employees who need access to your information in order to do their jobs are allowed access. Our security policies are reviewed periodically and revised as required. A Special Note for Parents Concerning Privacy At New Tier Communications, we take our responsibilities to our younger visitors seriously. It is the intention of New Tier Communications, the operator of this website, and our Partners to fully comply with the requirements of the Children's Online Privacy Protection Act and the Guidelines promulgated by the Children's Advertising Review Unit of the Better Business Bureau. In general, we do not knowingly collect personal information from children under 13 ("children") via the website, and we use age screening mechanisms to help prevent children from posting personal information on the website, such as in our fan chat rooms. We do not require children to register or to otherwise disclose personal information to participate in the activities in the KIDS section of our website. From time to time, we may offer children the opportunity to enter promotions or contests via the Site. In those cases, the child will be asked only to provide an email address, as well as his or her parent's email address. Upon receipt of the information, we will send an email to the parent indicating that the child has registered, providing information on the program and giving instruction on how the parent can remove the child from the promotion or contest. We will then use the information only to notify the contest winners and their parents that they have won. We require that the winner's parent provide us with all information needed to award the prize. Information collected during the contest will not be used or stored after the contest ends, other than as needed for legal requirements in connection with the promotion. In no event will New Tier Communications collect any personal information from children in connection with an on-line contest or promotion other than email address and parent's email address. In no event will New Tier Communications use the personal information other than for purposes of awarding contest prizes. We may also post information on the website about other promotions or contests that are open to children but that require other personal information (such as home address or favorite team) to enter. For these contests, children will be required to print a paper entry form from the website and have their parents sign and mail or fax the form to us. Children are not permitted to independently provide personal information via the website or to enter these contests online.
Notification of Changes and Your Acceptance of this Privacy Policy By using this Site, you signify your agreement to the terms of our privacy policy.
